Claude Lost in Court. Should You Actually Change Anything?

The Pentagon won a round against Anthropic. Before you cancel Claude, understand who the ruling covers—and why another court ruled differently.

The practical answer

Your Claude subscription is not the Pentagon’s procurement contract. On September 25, the D.C. Circuit upheld Anthropic’s exclusion from the Pentagon’s supply chain. The decision concerns military use and contractors’ work for the department; it does not order ordinary subscribers to stop using Claude.

My take: don’t let a frightening label make your subscription decision for you. The useful question is what work you are doing with Claude. Panic-canceling is a poor substitute for checking that boundary, just as ignoring a procurement problem because your chatbot still opens would be.

What the judges actually disagreed about

The vote was 2–1. Judge Gregory Katsas wrote the majority opinion, joined by Judge Neomi Rao. They accepted the Pentagon’s concern that Claude’s restrictions could interfere with necessary military functions. Judge Karen LeCraft Henderson dissented: in her reading, the statute targets subversive manipulation, not a supplier openly enforcing restrictions.

The courts reached different rulings on different legal questions.

Anthropic’s stated position is that the military makes operational decisions, but that fully autonomous weapons and mass domestic surveillance need boundaries. In its February 26 statement, the company argued that frontier AI was insufficiently reliable for fully autonomous weapons and that AI-enabled domestic surveillance threatened fundamental liberties. Those are Anthropic’s arguments, not findings that settle the dispute.

But didn’t Anthropic win in California?

Yes. On August 27, Judge Rita Lin ruled that the broader challenged measures involved unconstitutional retaliation and procedural failures. Her case addressed a designation under 10 U.S.C. § 3252 and related directives. The September decision concerns procurement action under a different statute, 41 U.S.C. § 4713. It is not an appeal overturning Lin’s decision.

In a statement provided to ABC News on Friday, Anthropic disagreed with the appellate decision and said it was considering further review. That describes an option under consideration, not an appeal already filed.

Check the work before changing the tool

Anthropic’s March 5 explanation distinguished using Claude directly for Pentagon contracts from unrelated use by companies that also have those contracts. Treat that as the company’s dated explanation of scope, not a fresh clearance for your project.

Check Claude’s work on your actual tasks before deciding whether to switch.
  1. Personal subscriber: resist the reflex cancellationJudge your subscription by whether it helps with your actual tasks. I would not switch tools solely because of this procurement dispute.
  2. Business user: identify the projectAsk your organization whether the intended use supports Pentagon work. Give the reviewer a concrete workflow, including where Claude enters it, rather than asking whether the entire company is allowed to use AI.
  3. Defense contractor: get a project-specific answerHave your contracting or legal team check applicable instructions and the two proceedings before continuing the affected workflow. Request a written answer tied to the contract. Don’t treat access through another account or seller as clearance.

Section D.2 incorporates Anthropic’s Usage Policy. These commercial terms govern API keys and offerings that reference them; they are not the Pentagon’s negotiated contract. Their relevance is narrower: commercial access comes with usage obligations. Buying access does not itself establish permission for every intended use.
